How Blood Alcohol Concentration Is Used for DUI Investigations

Blood alcohol concentration (BAC) measures the amount of alcohol found in your blood system. If an officer has reasonable suspicion that someone has been driving drunk, that officer can arrest the driver and ask him or to submit to a blood or breath test to measure BAC.

The California Driver Handbook states the following:

  • All drivers who are over the age of 21 who measure a BAC of 0.08% or above are considered legally drunk and are prohibited from operating a vehicle.
  • Drivers with a commercial driver’s license (CDL) and are found driving with a BAC of 0.04% are considered over the legal limit.
  • Drivers under the age of 21 and drivers who are currently serving DUI probation are prohibited from driving with a BAC of 0.01%.

How Is BAC Measured?

Breath tests use a breathalyzer unit. The driver will blow into the device to provide a breath sample. On the other hand, for a blood test, the driver will provide a sample of their blood, which is brought to a laboratory for testing.

Penalties for BAC Test Refusal

When a police officer pulls you over, he or she may ask you to submit to a blood or breath test to measure your BAC.
