Penalties You May Face
An individual may be charged with a felony DUI in a number of circumstances. If you have been previously arrested formultiple DUI offenses and this is your fourth DUI charge, you may be charged with felony DUI. In this case, you may receive a sentence of up to 3 years in prison and 4 years to permanent driver’s license suspension if convicted.
Another reason you may be charged with felony DUI is if there was an injury involved due to your alleged drunk driving or other types of DUI. You can receive 3 years in prison plus anywhere from 1 to 3 additional years for each person who was injured in the car accident. A particularly zealous law enforcement officer or prosecutor may seek a felony DUI conviction if the individual has been charged with just one previous DUI and there are circumstances that the prosecutor deems warrant such a harsh charge.
