A field sobriety test is often one of the standard procedures that a law enforcement officer will do if he or she suspects an individual of drunk driving or DUI involving drugs or medication. Once an officer pulls you over, he or she can ask you to perform one or more of a variety of field sobriety tests in order to make a judgment of whether or not you are impaired and should be arrested.

There are only three standardized field sobriety tests:

  • One leg stand
  • Walk and turn
  • Nystagmus

In the one leg stand, the officer instructs the suspected drunk driver to stand in place and raise one leg while counting. For the walk and turn, the driver is told to walk nine steps with heal to toe, do an about-face at the end of the nine steps and return in the same fashion.

The nystagmus test (refers to rapid and uncontrolled eye movements) is where the officer checks the driver's ability to follow a fixed point on an object — such as a finger or pen or similar object — while it is moved horizontally and vertically. It is pretty clear that any one of these tests could be failed by an individual for a variety of physical conditions having nothing whatsoever to do with alcohol or drug consumption. Even the National Highway Traffic Safety Administration has stated that the best of the three standardized field sobriety tests is only 77% accurate. This leaves a big margin for error.

All three tests allow for the introduction of all sorts of arbitraries and a possible arrest based solely on an officer's subjective opinion or observation. This is why it is imperative that you retain legal counsel from a Ventura sobriety test lawyer who is dedicated to DUI defense. At The Law Offices of Robert F.
